What Fairness-and-Denial Research Could Have Told the Florida Supreme Court (and Can Tell the Rest of Us)

Abstract

Recent research on fairness adds much to our understanding of a norm that everyone grasps but few can articulate. The controversies surrounding the court decisions about Election 2000 show what can happen when individuals and institutions focus on different aspects of fairness.
