Abstract

In mid-2005, three pillars of liberty were destroyed, perhaps forever, when President George W. Bush signed into law the REAL ID Act and the U.S. Supreme Court effectively rewrote the Interstate Commerce Clause and the Fifth Amendment’s Takings Clause. Government decision makers could impose these changes on Americans only by using tactics that made a mockery of both constitutionally mandated procedure and consensual legislative deliberation.
