   I don’t think you’ve stated that correctly.

   Milton Friedman wrote (1962, Capitalism and Freedom): “A common objection to totalitarian societies is that they regard the end as justifying the means. Taken literally, this objection is clearly illogical. If the end does not justify the means, what does? But this easy answer does not dispose of the objection; it simply shows that the objection is not well put. To deny that the end justifies the means is indirectly to assert that the end in question is not the ultimate end, that the ultimate end is itself the use of proper means. Desirable or not, any end that can be attained only by the use of bad means must give way to the more basic end of the use of acceptable means.”

   That is to say, total security is not a realistic end. We can never be 100% safe. We should aim to be as safe as is consistent with the constitution and the rule of law. So what you mean to say is that policymakers are pursuing the wrong end, not that the end does not justify the means (indeed, the ends always justify the means, that is a truism).

   The problem is also that, in the case of tracking vehicles, the means won’t achieve the stated ends (of improving security). Just as torture won’t guarantee reliable information.

   What libertarians should be saying is that “Freedom Works”. The end (of improving security) is best achieved by other means (of reducing foreign intervention, etc.).

2. Sukrit,

   You have correctly re-stated the rationale of utilitarian ethics (a la Jeremy Bentham, John Stuart Mill, Milton Friedman, John Rawls and most other “modernists”) that claims that the choice of means should only really be constrained by whether a desired end is obtained. However, this is exactly the fallacy of utilitarianism. The issue is not just whether any means achieves a desired end because every means is an end in itself. Means are chosen actions which themselves have ethical content, and every act produces outcomes that do not disappear when an end state is reached. The end is in fact only the culmination of the means.

   Furthermore, the basis for selecting an end state itself as desirable is always based on an objective ground of moral principle (natural law). For example and as you note, “security” is such a desirable or “good” end based on objective moral criteria, but each means to achieve “security” must also be subject to the same objective moral norms. And, either ethical norms exist as objectively true and universal or not. If they do not, then the claimed end of “security” itself is meaningless and cannot be asserted as a “good.”

   The problem with utilitarianism is that it suspends moral ethics for means but then insists that ethics magically reappear to determine proper ends. This moral ambiguity and situational ethics is intrinsic to utilitarianism and why utilitarianism is at best a shifting sands and at worst a rationale for tyranny. If individual rights, the rule of law, and the Golden Rule can always be suspended for some future end state, then individual rights, the rule of law, and Golden Rule are not viewed as objective moral principles. The utilitarian hence faces an unworkable dilemma.

   As C.S. Lewis notes in critiquing the “long-run” (ends) of utilitarianism in his book, The Abolition of Man:

   “Either we are rational spirit for ever to obey the absolute value of the Tao [natural law], or else we are mere nature to be kneaded and cut into shapes for the pleasures of masters who must, by hypothesis, have no motive but their own ‘natural’ impulses. Only the Tao provides a common human law of action which can over-arch rulers and ruled alike. A dogmatic belief in objective value is necessary to the very idea of a rule which is not tyranny or an obedience which is not slavery. . . . The process which, if unchecked, will abolish Man goes on apace among Communists and Democrats no less than among Fascists. . . . [M]any a mild-eyed scientist in pince-nez, many a popular dramatist, many an amateur philosopher in our midst, means in the long run just the same as the Nazi rulers of Germany.”

3. Ends do not justify means. An end is something that is aimed for. But means produce a plethora of results, some more intended than others. The ends are only a small part of the actual results. To justify the means, all their (rationally expectable) results would have to be justified.
